NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
Please review these rules carefully before entering the Field Agent Sweepstakes (the “FA Sweepstakes”). By submitting an entry, you fully and unconditionally agree to be bound by these Official Rules (the “Rules”) and any and all determinations made by Field Agent, Inc. (the “Sponsor”), and you acknowledge that you satisfy all eligibility requirements necessary to participate in the FA Sweepstakes.
Apple is not affiliated nor a sponsor of ticket job sweepstakes.
1. Eligibility; Agreement to Rules.
The FA Sweepstakes is open and available to legal residents of the fifty (50) United States and the District of Columbia who are at least 18 years of age at the time of entry. The FA Sweepstakes is not open to employees or immediate family members (spouses, domestic partners, parents, grandparents, siblings, children, and grandchildren) of employees of Sponsor or any person living in the same household of employees of Sponsor or any entity involved in any aspect with the administration of the FA Sweepstakes, and each of their respective parents, subsidiaries, affiliates, advisors, or related entities. Winning a prize is expressly contingent upon your unconditional fulfillment of all requirements and obligations set forth in these Rules. The FA Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.
By participating in the FA Sweepstakes, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Field Agent, Inc., as final and binding as it relates to the content. The Sweepstakes is subject to all applicable federal, state and local laws.
2. How to Enter.
The FA Sweepstakes must be entered by (i) downloading and installing the latest version of the Field Agent mobile application (the “App”) on a compatible device (if you do not already have the App); and (ii) completing certain non-monetary nominal tasks on the App (a “Ticketed Matter”). Examples of a Ticketed Matter include updating content on your App user profile, completing brief informational surveys and screeners, and watching short training or instructional videos related to the App. To learn more about how to download and install the latest version of the App, visit www.fieldagent.net. Sponsor will assign a designated number of FA Sweepstakes tickets (each being a “Ticket”) to each Ticketed Matter, which will be awarded to you upon completion of the Ticketed Matter. Once you have obtained one (1) Ticket during the applicable Monthly Entry Period, you will automatically receive one (1) entry into that Monthly Entry Period drawing. You must obtain your Ticket prior to 11:59 p.m. Central Time (“CT”) on the Ending Date (as set forth in the chart below) of the applicable Monthly Entry Period in order to be eligible for that Monthly Entry Period drawing. A Ticket is only valid during the Monthly Entry Period in which it is obtained and will not be valid for or included in any subsequent Monthly Entry Period drawing. You will not receive confirmation that a Ticket has been earned.
Each participant in the FA Sweepstakes for a Monthly Entry Period will be entered only once for the FA Sweepstakes for that specific Monthly Entry Period. Obtaining more than one (1) Ticket does not increase your chances of winning. However, Sponsor does reserve the right to increase the value of the prize based upon the number of Tickets obtained by the winner during the applicable Monthly Entry Period.
You may not use multiple user accounts to enter the FA Sweepstakes, and all entries submitted through multiple accounts will be disqualified. Additionally, any entries received by Sponsor through the use of any automated system to participate in the FA Sweepstakes will be disqualified. Sponsor shall have sole and absolute discretion to disqualify any entry suspected to be in violation of these Rules.
Your Ability to Opt-Out of the FA Sweepstakes
Users of the App may choose to opt-out of this FA Sweepstakes by sending an email to support@fieldagent.net. The email must express the user’s desire to opt-out of the FA Sweepstakes and include the user’s name, email address, phone number, and username associated with the App. Upon receipt, Sponsor will notify the user that such user has successfully opted out of the FA Sweepstakes. Once a user opts out of the FA Sweepstakes, such user will be excluded from all subsequent FA Sweepstakes drawings that occur after receipt of the opt-out request, regardless of the number of Ticketed Matters completed.
3. When to Enter.
The FA Sweepstakes begins on the first day of the given month at 12:00 a.m. and will end on the last day of the given month at 11:59 p.m. (the “Contest Period”), unless extended by Sponsor in its sole discretion. All times are Central Time (US) (GMT UTC-6 Central Standard Time and UTC -5 Central Daylight Time). The FA Sweepstakes consists of twelve (12) separate calendar monthly entry periods (each a “Monthly Entry Period”) as set forth in the chart below. All entries must be received by 11:59 p.m. on the last day of the calendar month of the then current Monthly Entry Period.
4. Mailing List.
By entering the FA Sweepstakes, you consent to being placed on a mailing list for promotional, marketing, and other materials from Sponsor. If you do not wish to receive these communications from Sponsor, you may remove your account from our mailing list by updating or changing your email settings.
5. Prize.
Sponsor will award one (1) prize during each Monthly Entry Period. Each prize shall consist of an item(s) of retail merchandise or retail services, a gift card redeemable for certain item(s) of retail merchandise or services, or payment in cash transferred into the prize winner’s Field Agent account, by check card or by check drawn on the account of Sponsor. All gift cards are redeemable with the specific businesses issuing such cards. There will be no substitutions, exchanges, variations or replacements made to (or issued or re-issued for or on account of) prizes or gift cards that are awarded, prizes which are redeemed with gift cards, or prizes paid in cash by transfer to the prize winner’s Field Agent account, by check card or check drawn on the account of Sponsor. It is the responsibility of each prize winner to redeem any gift card received as a prize. Sponsor will not replace any gift card that is lost or stolen once any gift card is delivered to a FA Sweepstakes prize winner. Each prize will be determined by Sponsor in Sponsor’s sole discretion. No greater than the number of prizes stated in these Rules will be awarded. Sponsor may substitute any prize with a prize of equal or greater value.
6. Prize Drawing.
The potential prize winner will be selected at a random drawing to be held on or about the Drawing Dates listed in the chart above. Prize winners will be notified via phone or e-mail within five (5) business days following the drawing. Sponsor shall have no liability for a prize winner’s failure to receive notices due to prize winner’s spam, junk e-mail or other security settings or from prize winners’ provision of incorrect or otherwise non-functioning contact information. If the selected prize winner cannot be contacted, is ineligible, fails to claim the prize within fifteen (15) days from the time the award notification was sent, or fails to provide a timely response to the email notifying his or her win, the prize may be forfeited and an alternate winner selected. The receipt by prize winner of the prize offered in the FA Sweepstakes for the applicable Monthly Entry Period is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY PRIZE WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS PRIZE WINNER OF THE FA SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
The prize will be awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
7. Odds of Winning.
Odds of winning depend on the number of eligible entries received. No purchase or payment of any kind is necessary to enter or win this FA Sweepstakes. A purchase will not increase your chances of winning.
8. Publicity.
By participating in the FA Sweepstakes or accepting a prize from the FA Sweepstakes you understand that Field Agent, Inc., anyone acting on behalf of Field Agent, Inc. or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the FA Sweepstakes, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.
9. Amendment to Sponsor’s Participation Agreement.
The Rules of these FA Sweepstakes are different and separate from the terms, conditions and rules of the Field Agent Participation Agreement. By participating in these FA Sweepstakes, you are subject to these Rules, and you agree to comply with and abide by these Rules notwithstanding anything to the contrary in the Field Agent Participation Agreement.
10. Additional Terms.
Sponsor may, to the maximum extent permitted by applicable law and in Sponsor’s sole discretion, change these Rules or cancel the FA Sweepstakes at any time; or modify, terminate, or suspend the FA Sweepstakes should viruses, worms, bugs, unauthorized human intervention or other causes beyond Sponsor’s control corrupt or impair the administration, security, fairness or proper play of the FA Sweepstakes or submission of entries. Sponsor is not responsible for: (a) any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any website; or (b) injury or damage to your or any other computer resulting from downloading any materials in connection with the FA Sweepstakes. The failure of Sponsor to enforce any term of these Rules shall not constitute a waiver thereof.
Sponsor may, in its sole discretion, disqualify any individual found to be: (i) tampering with the entry process, issuance or awarding of tickets or the operation of the FA Sweepstakes or App; (ii) acting in violation of these Rules; or (iii) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. The authorized subscriber of the user account used to enter the FA Sweepstakes at the actual time of entry will be deemed to be the participant and must comply with these Rules in the event of a dispute as to entries submitted by multiple users having the same e-mail or App user account. If any technical errors occur in the selection of a potential prize winner or if more prizes are claimed than the number of prizes being awarded as provided in these Rules, Sponsor may award the prize by random drawing from among all eligible claimants.
Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the FA Sweepstakes may be a violation of criminal and civil laws and should such attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
11. Applicable Law; Arbitration.
The FA Sweepstakes is arranged, sponsored, and managed by Sponsor in the state of Arkansas, USA. The laws of the state of Arkansas govern these Rules and all of the terms and conditions contained herein, without giving effect to any principles of conflicts of laws. You agree that any action at law or in equity arising out of or relating to these Rules shall be submitted to confidential arbitration in Fayetteville, Arkansas, except that, to the extent you have in any manner violated or threatened to violate Sponsor’s intellectual property rights, Sponsor may seek injunctive or other appropriate relief in any state or federal court in the state of Arkansas, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under these Rules shall be joined to an arbitration involving any other party subject to these Rules, whether through class arbitration proceedings or otherwise.
12. Release.
By entering you agree to release and hold harmless Field Agent, Inc. and its subsidiaries, affiliates, advertising and promotion agencies, officers, directors, shareholders, partners, representatives, agents, successors, assigns and employees (collectively, including Field Agent, Inc., the “Released Parties”) from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries, even if caused or contributed to by the negligence of any of the Released Parties. You agree that Sponsor’s decisions related to the FA Sweepstakes and all drawings are final.
13. Winner’s List.
Sponsor will publish a winner’s list on the App and on Sponsor’s website, located at app.fieldagent.net/ticket-jobs. The winner list will be published after Sponsor has confirmed winner’s eligibility requirements to participate in the FA Sweepstakes.
14. Privacy Policy.
All information submitted in connection with this FA Sweepstakes will be treated in accordance with these Rules and Sponsor’s Privacy Policy, located at app.fieldagent.net/privacy-policy/
15. Sponsor.
